The short version

  • We build and run automations (lead replies, follow-ups, booking reminders, marketing) for credit repair businesses. We don't provide credit repair, and we don't touch your dispute software.
  • You own your leads, contacts and content. You're responsible for making sure the messages sent to them are legal and that you have consent to send them.
  • Setup is a one-time fee. Ongoing plans are month-to-month, with no long-term contract.
  • We can't guarantee specific results like hours saved, reply rates or revenue.

This summary is for convenience. The full terms below are what apply.

01Agreement to these terms

These Terms & Conditions ("Terms") are an agreement between you and CRO Automation ("CRO Automation," "we," "us," or "our").

They apply when you visit [website URL] (the "Site"), book a free automation audit, or buy any of our services (together, the "Services"). If you use the Services on behalf of a business, you confirm you're authorized to accept these Terms for that business, and "you" means that business.

If you don't agree, please don't use the Site or the Services. If we sign a separate proposal, statement of work or service agreement with you, that document controls where it conflicts with these Terms.

02What we provide

CRO Automation designs, builds and maintains automated workflows for credit repair businesses. Depending on your plan, this may include:

  • Instant lead replies by text and email for ad forms, website forms and missed calls
  • Follow-up sequences, booking reminders and no-show messages
  • Newsletters, old-lead reactivation, review requests and referral asks
  • Connecting tools you already use, such as your CRM, Facebook and Google lead forms, Calendly, Gmail, Outlook, Zapier or Make, and SMS and email tools

The exact scope, timeline and deliverables for your build are described in your proposal or order. Work outside that scope is billed separately, with your approval first.

What we don't do

  • We are not a credit repair organization and do not provide credit repair, credit counseling, or dispute services to anyone.
  • We do not access, change or operate your credit repair or dispute software.
  • We do not provide legal, compliance, tax or financial advice. Anything we say about compliance is general information, not a legal opinion.

03Free automation audit

The free audit is a no-obligation review of your current lead handling and follow-up. Any estimates it produces, including hours saved, labor cost, or money saved, are projections based on the information you give us and common assumptions. They are not promises of results.

You don't have to buy anything after an audit. We may decline to offer an audit or Services to any business at our discretion.

04Your responsibilities

To get the Services working, you agree to:

  • Give us accurate information and the access we need (logins, API keys or admin invites) to the tools we're connecting
  • Review and approve every workflow and message template before it goes live. Our process is that we build it and you approve it; once you approve it, the content is yours
  • Keep your own accounts with third-party tools (like your CRM, SMS provider or email platform) in good standing and paid
  • Tell us promptly if something looks wrong, such as messages going to the wrong people or a workflow misfiring
  • Keep your login credentials secure and let us know if you think they've been compromised

05Messaging and compliance

The automations we build send messages on your behalf, to your leads and clients. Because you control who is contacted and what is said, you are responsible for making sure all messages comply with the law. That includes, where applicable:

  • The Telephone Consumer Protection Act (TCPA) and state telemarketing and "mini-TCPA" laws
  • The CAN-SPAM Act and other email marketing laws
  • The Credit Repair Organizations Act (CROA), the Telemarketing Sales Rule, and state credit services laws
  • Carrier rules for business texting, including A2P 10DLC registration and the CTIA Messaging Principles

In particular, you agree that:

  • You have (and can prove) the consent required to text, call or email every person in your lists and lead sources
  • Messages will identify your business and include a working opt-out (for example, "Reply STOP to opt out"), and opt-outs will be honored
  • Messages will not promise or guarantee credit score increases, removal of accurate negative items, or any specific credit result
  • You won't use the Services to send spam, deceptive content, or messages to people who have opted out
We set up opt-in and opt-out handling by default and write templates that avoid promising credit results, but we're not your lawyer. Please have your own attorney confirm your messaging is compliant before launch.

We may pause any workflow that we reasonably believe breaks the law, carrier rules, or these Terms, and we'll tell you why.

06Fees, billing and cancellation

Setup fee

Setup starts at $[X]. Your exact setup fee is listed in your proposal. [Choose one: It's due in full before work begins. / 50% is due before work begins and 50% at launch.]

Ongoing plans

Optional monitoring and support plans are billed monthly at $[X] per month, in advance, and renew automatically each month until cancelled. There's no long-term contract. You can cancel at any time by emailing [email protected] at least [X] days before your next billing date. Cancellation takes effect at the end of the current paid month.

Third-party costs

Our fees don't include costs charged by the tools your automations run on, such as your CRM subscription, SMS and phone number fees, carrier registration fees, or email sending fees. Those are billed to you by those providers, or passed through at cost if we pay them on your behalf.

Refunds

[Choose and edit: Setup fees are non-refundable once build work has started. / If we haven't started your build, we'll refund your setup fee in full.] Monthly fees are non-refundable for partial months.

Late payment

If a payment fails or is more than [X] days late, we may pause your ongoing support after giving you notice. Workflows that already live in your own accounts will keep running.

07Ownership

Your stuff

You keep all rights to your data, leads, client lists, logos, and the content of your messages ("Your Content"). You give us permission to use Your Content only as needed to provide the Services.

What we build for you

Once you've paid in full, the specific workflows, sequences and templates we build inside your accounts are yours to use and change as you like.

Our stuff

We keep ownership of our general methods, know-how, internal templates, frameworks and any tools we developed before or apart from your project. We may reuse general know-how and non-confidential approaches for other clients, but we will never share Your Content with them.

The Site, our brand, and our content (including blog posts and videos) belong to us. You may share links to them but may not copy or republish them without permission.

08Third-party tools

The Services connect to software we don't own or control, such as CRMs, SMS carriers, email providers, calendars and automation platforms. Your use of those tools is governed by their own terms and privacy policies.

We aren't responsible for their outages, pricing changes, API changes, account suspensions, or message delivery failures. If a provider change breaks a workflow and you're on an ongoing plan, we'll work to fix it as part of your support.

09Confidentiality

Each of us may share non-public business information with the other, such as your client lists, pricing, or processes. We'll each keep that information confidential, use it only for the Services, and protect it with reasonable care.

This doesn't apply to information that is already public, that the other party already had, or that must be disclosed by law. How we handle personal information is explained in our Privacy Policy.

10No guaranteed results

Numbers on our Site, in testimonials, or in your audit (like hours saved per week, response times, or money saved) reflect specific examples or estimates. Your results will depend on your lead volume, your offer, your team and how you use the system.

We don't guarantee any particular number of leads, bookings, sales, reply rates, time savings or revenue.

11Disclaimer of warranties

We'll perform the Services in a professional and workmanlike manner. Other than that, the Site and Services are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Services or any third-party tools will be uninterrupted, error-free, or that every message will be delivered.

12Limitation of liability

To the fullest extent allowed by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, or data, even if advised they were possible.

Our total liability for any claim relating to the Site or Services is limited to the amount you paid us in the [3 / 6 / 12] months before the event that gave rise to the claim.

Some states don't allow certain limits, so parts of this section may not apply to you.

13Indemnification

You agree to defend and indemnify CRO Automation and its owners, employees and contractors against claims, fines, and costs (including reasonable attorneys' fees) arising from: Your Content; messages sent to your contacts through workflows you approved; your lack of consent to contact someone; your violation of any law, including the TCPA, CAN-SPAM, CROA, or state credit services laws; or your breach of these Terms.

14Ending the relationship

You can stop using the Services at any time, as described in "Fees, billing and cancellation." We can end or suspend the Services if you materially breach these Terms and don't fix it within [X] days of notice, or immediately if continuing would expose us or others to legal risk.

When the Services end, we'll remove our access to your accounts. The automations built inside your accounts stay with you. Sections that by their nature should survive (like ownership, confidentiality, liability limits and indemnification) continue after termination.

15Governing law and disputes

These Terms are governed by the laws of the State of [State], without regard to its conflict-of-law rules. Before filing any claim, each of us agrees to try to resolve the dispute informally by contacting the other in writing and allowing 30 days to work it out.

If that doesn't work, any dispute will be resolved in the state or federal courts located in [County, State], and both parties consent to jurisdiction there. [Optional: Replace with a binding arbitration clause if your attorney recommends one.]

16General terms

  • Changes. We may update these Terms. We'll change the "Last updated" date and, for active clients, notify you by email at least [X] days before material changes take effect.
  • Entire agreement. These Terms plus any signed proposal or order are the whole agreement between us about the Services.
  • Severability. If a court finds part of these Terms unenforceable, the rest still applies.
  • No waiver. Not enforcing a right right away doesn't mean we give it up.
  • Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger or sale of our business.
  • Independent contractors. We're an independent contractor, not your employee, partner or agent.
  • Force majeure. Neither of us is responsible for delays caused by events beyond reasonable control, such as outages at third-party providers.
